Terms of Service

1. Acceptance of Terms

By accessing or using SmartOm (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including free and Pro subscribers.

2. Service Availability

Pro subscription grants unlimited access subject to reasonable use limits and continued business operation. We reserve the right to suspend or discontinue the service at any time with reasonable notice. We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible.

3. Reasonable Use Policy

Pro plan is limited to 500 listing generations per month per account. Automated or bulk API usage beyond this limit may result in suspension. This limit covers 99% of active real estate agents and exists to ensure service quality for all users.

You agree not to use the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other user's use of the Service. Automated scraping, bulk generation scripts, or API abuse beyond reasonable individual use is prohibited.

4. Free Plan

Free accounts receive 3 listing generations at no charge. Free usage is subject to availability and may be changed or discontinued at our discretion. No payment information is required for free access.

5. Payments

Payments for the Pro plan are processed securely by Square, Inc. We do not store your card data on our servers. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until cancellation.

All prices are stated in US Dollars (USD). We reserve the right to update pricing with at least 30 days' notice to existing subscribers.

6. Cancellation & Refunds

You may cancel at any time. Cancellation takes effect at the end of your current billing period. You will retain Pro access through the end of your paid period. No partial refunds are issued for unused days in a billing cycle.

We may cancel or modify the service at any time; in such cases pro-rata refunds will be provided for any remaining paid period. To cancel, contact us at smartom@myyahoo.com or use the cancellation option in your account settings.

7. AI-Generated Content

AI-generated content is provided as-is, without warranty of accuracy, completeness, or fitness for a particular purpose. The agent (user) is solely responsible for reviewing all AI-generated content before publishing, submitting to MLS, or distributing to clients.

SmartOm makes no representations that generated descriptions comply with local MLS rules, fair housing laws, or any other applicable regulations. It is your responsibility to ensure compliance. You retain ownership of content generated using your account.

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Generate content that is discriminatory, misleading, fraudulent, or violates fair housing laws
• Share account credentials or resell access to the Service
• Attempt to reverse engineer, copy, or replicate the underlying AI models
• Use automated tools to access the Service beyond its intended use

9. Limitation of Liability

To the maximum extent permitted by applicable law, SmartOm and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in a court of competent jurisdiction.
